Comment: Contractor substantial failures amounting to no less than a breach of our Contract, signed in January 2022, justifying termination:
- Failure to properly protect the open roof during construction, resulting in significant water damage to the Property, necessitating significant water and mold remediation, as well as other damage to my Property;
- Failure to adhere to contact and agreed upon specification for fixtures and finishes;
- Failure to properly supervise and monitor the work performed on the Property. Specifically, we have not seen you, as the Contractors’ senior manager, at the Property for at least 120 days, and have not seen a construction supervisor on site at the property since the beginning of July 2023; and
- Failure to timely schedule work and maintain the represented schedule without just cause in violation of Contract
