Comment: I had two contracts enforced with the seller of my most recent property purchase. The seller is also a contractor and real estate developer. One contract stated the seller will agree to repair 3 items after closing which were included in the purchase price. Those items were Tuck point, repair of the front porch steps, and rubber roof bitumen over my front balcony. The contractor never started nor completed any of the repair items within the deadline stated in contract. Therefore I have asked numerous of times to reimburse so I may move on. He has refused. The second contract was a rider agreement to the real estate purchase contract. The rider agreement specified $15,000 will be held in escrow for the seller/contractor to renovate my basement and install privacy fencing. Although the privacy fence was installed the basement was never started nor completed within the deadline specified in contract. I've asked to release the remaining balance ($11,500) so I may find someone else to complete work in a timely and workmanlike manner. His attorney is holding the remaining balance and they are refusing to sign an authorization form to release my money to me.
